What was the client's problem when they contacted KHC?

Client: "We have been doing heritage surveys for over a year and are yet to see a heritage report. We do not know what has been surveyed or not. There is also a site right on our mining area."

What was the outcome?

  • A letter updating on the status of surveys by March 2011;
  • A Heritage Report by June 2011;
  • Advice from DIA limiting the extent of consultation to be done with one of the claim groups.

What were the hurdles or unexpected roadblocks?

A couple of hurdles we faced were:

  • A heritage protocol that was unclear about obligations and timelines; and
  • A conflict between several native title groups.

What skills were exhibited by KHC staff that facilitated the workable outcome?

Negotiation skills that enabled the parties (mining company and native title party) to identify common interests.

What was learnt that can be applied to future issues?

The need to be very clear about timelines for delivery in relation to this particular heritage protocol with this particular land council.
